Is Professional Misconduct a Criminal Offence?

Professional misconduct usually refers to the fact that a licensed professional (such as a physician, dentist, nurse, lawyer or police officer) has been charged with and found guilty of a regulatory offence by the Discipline Tribunal of his or her professional licensing body.  It is not considered a criminal offence in itself in Ontario. Professional misconduct refers to actions taken by a professional licensee that violates the ethical standards, rules, or codes of conduct set forth by his or her professional licensing body.

When a professional is accused of misconduct, the matter is typically handled through the regulatory body overseeing their profession. This body has the authority to investigate the allegations and take appropriate disciplinary actions, which may include warnings, fines, reprimands, suspension, or revocation of the professional's license and registration.

It is important to note, however, that certain forms of professional misconduct may also trigger criminal liability. For example, if the alleged professional misconduct involves fraudulent activities, theft, assault, the use or sale of controlled drugs or substances, or other prohibited criminal acts, the professional may also be subject to a separate criminal prosecution in Court, apart from and in addition to the disciplinary hearing before the professional licensing body's Disciplinary Tribunal.
